Miami Bankruptcy Attorney Timothy Kingcade Explains Why Bankruptcy Filings are Down in Southern Florida

(Miami, Florida) December 10 - Firm partner Timothy Kingcade of Kingcade & Garcia, P.A., located in Miami, Florida, was recently interviewed by the Ft. Lauderdale Sun-Sentinel about the surprising decline in consumer bankruptcy filings in Southern Florida.

In November, personal bankruptcy filings for south Floridians fell for the third month in a row. According to the U.S. Bankruptcy Court in Miami, bankruptcies in Broward County, Palm Beach County and Miami-Dade county fell by nearly 19 percent compared to October.

While bankruptcy filings are still higher than November of last year, the decrease in the number of people filing is not because the economy is recovering. In fact, the recession has continued for so long that financially troubled individuals, who would benefit from bankruptcy, feel that they cannot afford to file.

Said Kingcade, "We've come to the point where bankruptcy is a luxury. People tell me that they are on food stamps and struggling to the point where they cannot even afford the $1,500 cost to hire an attorney and file for bankruptcy. They don't view it as a priority. They say, 'if I'm doing poorly and everyone else is doing poorly, I can worry about it another day.'"

But individuals and families shouldn't be worried about not being able to afford it, attorney Kingcade explained. "Bankruptcy is about providing you with the opportunity to make your life better and start over. Coming up with the money to file bankruptcy is worth getting a fresh start."

Because of financial constraints, Kingcade also noted that couples are delaying filing for divorce and bankruptcy. Another reason for declining bankruptcy filings is the recent halt in the foreclosure process - credit collections have slowed as paperwork is being closely scrutinized, which means delays in filing for bankruptcy.
